06. Real Estate and Property Disputes
Protecting title, possession, and value in property disputes:
Few assets are more valuable or more litigated than real estate. Property disputes turn on documents, timelines, and the speed with which a party secures interim protection. We act for individuals, business families, non-resident Indians, and developers in the full range of real estate and property litigation, from contested title and possession to high-value development and redevelopment disputes.
We pay particular attention to the practical realities our clients face: an NRI discovering encroachment or misuse of a power of attorney from abroad, a family whose property is caught up in a succession dispute, a buyer left exposed by a delayed or defaulting developer, or a business protecting a commercial asset from a competing claim.
What we handle:
Title and ownership disputes.
Declaration suits, challenges to and cancellation of sale deeds and instruments, disputes over chain of title, and competing claims of ownership.
Possession and eviction. Suits for possession, eviction and recovery, mesne profits, and protection against unlawful dispossession.
Agreements to sell and specific performance.
Enforcement of, and defence against, agreements to sell, including specific performance, refund, and damages.
Partition and succession-linked property.
Partition suits, disputes among co-owners and family members, and property matters arising out of inheritance and family settlements — handled with discretion where private interests are involved.
Developer, builder, and Contractual matters.
Delay, default, and quality disputes, and remedies before the real estate regulatory authorities and the civil courts, including for buyers and associations.
Miscellaneous.
Rent, eviction, renewal, and commercial lease disputes, and the enforcement or defence of lease and licence arrangements. Disputes arising out of secured lending, including proceedings connected with the SARFAESI framework and the Debts Recovery Tribunals.

Title investigation and risk review on disputed or high-value property, so that a position is taken with full knowledge of the record.
Approach:
We start with the documents. Establishing the chain of title, the sequence of events, and the precise relief required is the foundation of every property matter we run. Where the asset is at risk, we move quickly to secure interim protection, and then pursue a resolution through litigation or settlement that protects both the property and the client's wider interests. For NRI and out-of-station clients, we structure the engagement so that the matter can be run effectively without their constant physical presence.
